The NSW planning policy which allows the creation of rural landsharing communities could be abolished with the introduction of a new planning system for the state.

SEPP 15 – the State Environmental Planning Policy for Rural Landsharing Communities – will be reviewed for "relevance of topic", according to a Green Paper on the proposed planning system.

Submissions on the Green Paper will be accepted until September 14 and can be uploaded at http://haveyoursay.nsw.gov.au/newplanningsystem?module=form#tool.

The Green Paper states: "The present multiplicity of State Environmental Planning Policies, presently numbering 47, will be reviewed for relevance of topic and language."

SEPP 15 will be included in the review.

"Those which need to remain will be collapsed into a single document that will comprise the State level controls in the unitary planning document.

"The result will be a comprehensive single set of State controls applicable in a relevant local government area."

The Green Paper recommends that:

• A review be undertaken of the present range of State Environmental Planning Policies to determine which policies should be retained.
• The process be one in which public submissions are to be invited.
• After the completion of the review, those controls that should remain and which cannot be incorporated in a digitally mapped form are to be collapsed into a single well indexed document to be known as the State Development Controls.
• The review and consolidation processes are to be undertaken prior to the coming into effect of the proposed Sustainable Planning Act.

The Green Paper justifies the rationalisation of SEPPs, pointing to Victoria which has "a single planning document" and to Queensland where the number of state-based policies is "more limited".

Neither Victoria nor Queensland have provisions for landsharing communities.
